Sarpanch Election Petition: How to Challenge the Result in 30 Days

Lost by a handful of votes, or think the winner was not eligible? There is exactly one legal route, and the clock starts the night the result is declared.
Step by stepHow to Challenge a Sarpanch Election Result: 5 Steps
- 1
🧾 At the counting table: ask for a recount
Before the result is declared, give the Returning Officer a written recount request with reasons. Keep a copy with his signature or note.
- 2
📂 Collect papers
Get certified copies of the result sheet, nomination papers and scrutiny order. Write down witness names while memories are fresh.
- 3
⏱️ Count 30 days from the result
The petition must reach the District Judge within 30 days of the declaration of the result (Rule 80). For phase 1 sarpanchs declared on 24 October, that is about 23 November 2026.
- 4
⚖️ File through a lawyer
Only a candidate at that election can file. Join the winner and other candidates as respondents, verify the petition and attach documents. The judge may send it to a Civil Judge for trial.
- 5
🏛️ Decision and the High Court
The District Judge's decision is final under Section 43, but the High Court can still be approached in its writ jurisdiction (Articles 226 and 227) in a proper case.
GroundsGrounds for a Sarpanch Election Petition
| Ground | Example |
|---|---|
| Winner was not qualified or was disqualified | Under 21, not on the panchayat's voter list, holding a contract with the panchayat, or another Section 19 bar |
| Corrupt practice | Bribing voters with cash or liquor, threats, impersonation, appeals on religion or caste |
| Wrong rejection or acceptance of nomination | Your valid nomination was rejected at scrutiny; or an ineligible candidate's paper was accepted |
| Irregularity that changed the result | Valid ballots rejected, votes counted for the wrong candidate, margin smaller than the disputed votes |

The lawOnly One Door: Article 243-O and Section 43
243-O. Bar to interference by courts in electoral matters.— Notwithstanding anything in this Constitution,— (a) the validity of any law relating to the delimitation of constituencies or the allotment of seats to such constituencies, made or purporting to be made under article 243K, shall not be called in question in any court; (b) no election to any Panchayat shall be called in question except by an election petition presented to such authority and in such manner as is provided for by or under any law made by the Legislature of a State.
Once a panchayat election is over, you cannot stop or undo it by a complaint to the Collector, a writ, or a protest. Article 243-O allows only one door: an election petition before the authority State law names. In Rajasthan that is the District Judge under Section 43, and the deadline is 30 days from the result.
🏠 Everyday analogy
Like a cricket review: you must ask for DRS in time and with a reason; once the next ball is bowled, the decision stands.
🇮🇳 Real Indian example
Suppose a sarpanch candidate in Tonk lost by 9 votes and 14 of her ballots were rejected for a smudged stamp. She asks for a recount at the table, then files a petition within 30 days with the result sheet.
ConstitutionElection Petition and the Constitution
Article 14: Equal and fair election
A free and fair poll treats every candidate equally; the petition is how that is tested.
Article 21: Fair procedure
Both the petitioner and the winner get a fair hearing with evidence before the court decides.
