The ConstitutionSarpanch Election in the Constitution: Articles 243B to 243F
243B. Constitution of Panchayats.— (1) There shall be constituted in every State, Panchayats at the village, intermediate and district levels in accordance with the provisions of this Part.
(2) Notwithstanding anything in clause (1), Panchayats at the intermediate level may not be constituted in a State having a population not exceeding twenty lakhs.
243C. (5) The Chairperson of— (a) a Panchayat at the village level shall be elected in such manner as the Legislature of a State may, by law, provide; and (b) a Panchayat at the intermediate level or district level shall be elected by, and from amongst, the elected members thereof.
243E. Duration of Panchayats, etc.— (1) Every Panchayat, unless sooner dissolved under any law for the time being in force, shall continue for five years from the date appointed for its first meeting and no longer.
(3) An election to constitute a Panchayat shall be completed— (a) before the expiry of its duration specified in clause (1); (b) before the expiration of a period of six months from the date of its dissolution.
243F. Disqualifications for membership.— (1) A person shall be disqualified for being chosen as, and for being, a member of a Panchayat— (a) if he is so disqualified by or under any law for the time being in force for the purposes of elections to the Legislature of the State concerned: Provided that no person shall be disqualified on the ground that he is less than twenty-five years of age, if he has attained the age of twenty-one years; (b) if he is so disqualified by or under any law made by the Legislature of the State.
The Constitution creates a three-tier panchayat (village, block, district) and says every panchayat lasts five years, with fresh elections before the term ends. But it leaves one big choice to each State: how the village head (sarpanch) is chosen. In Rajasthan, Uttar Pradesh, Madhya Pradesh, Bihar and many other States the sarpanch is elected directly by all village voters; in Kerala the panchayat president is chosen by the elected members.
🏠 Everyday analogy
A gram panchayat is like a joint family council for the whole village: the ward panchs are the family elders of each lane, and the sarpanch is the head everyone chose together.

ProcessSarpanch Election Process Step by Step: Lottery to Upsarpanch
- 1Reservation lottery
Before the poll, sarpanch posts and ward seats are reserved by rotation for SC, ST, OBC and women. In Rajasthan 50 per cent of posts are for women.
- 2Schedule and code of conduct
The State Election Commission announces phases. In 2026 it announced them on 3 October, and the code of conduct began at once.
- 3Nomination
Fill the form before the Returning Officer with proof of age, caste certificate if needed, a no-dues certificate, an affidavit on assets and criminal cases, and the deposit receipt.
- 4Scrutiny and withdrawal
Papers are checked; candidates may withdraw by the fixed date. Then each gets a free symbol like a lantern, a tractor or a mobile phone.
- 5Polling day
At the village booth you get two ballot papers: ward panch and sarpanch. Stamp your choice, fold, drop in the box. Indelible ink goes on your finger.
- 6Counting the same evening
In Rajasthan the panch and sarpanch count happens at the panchayat headquarters right after polling; the winner gets the certificate that night.
- 7Upsarpanch election
Soon after (in 2026, the next day), the newly elected panchs and sarpanch elect the upsarpanch from among the panchs.
- 8Expense account and challenge
Every candidate files an account of election spending. A loser can challenge the result only by an election petition before the court named in State law (Art. 243O).
A sarpanch election is the most local election in India, often decided by a few dozen votes. That is why turnout is so high: in the first phase of Rajasthan's 2026 sarpanch polls, about 83 per cent of voters turned out, far above most city elections.
🇮🇳 Real Indian example
In a 2,000-voter panchayat, a candidate who visits every home and wins by 37 votes becomes sarpanch for five years, managing lakhs of rupees of Finance Commission grants for roads, water and drains.
